The treatment takes place in the practice of Katinka Tchernova or if desired via Skype or Whasapp and according to the method developed by Katinka Tchernova.
The client declares that he agrees with the method to be followed by Katinka Tchernova, which in certain cases may necessitate confronting attitude and / or physical contact.
After the assignment has been concluded, there is an agreement, whereby Katinka Tchernova performs services to the best of her knowledge and ability. The client is expected to give her the opportunity to perform the agreed services. This includes, among other things, a cooperative approach and the provision of sufficient information for determining and performing the work.
The Client himself is responsible for the consequences of the treatment / consultation and shall not hold Katinka Tchernova liable for damage resulting from what arises from and / or relates to the treatment / consultation.
The client remains fully responsible for his behavior and decisions or the consequences of the treatment / consultation at all times. Katinka Tchernova is not liable for damage, of whatever nature, that may arise for the client and / or third parties from or is related to the services provided by Katinka Tchernova, all in the broadest sense of the word. To the extent that Katinka Tchernova is liable, this liability is limited to the amount charged for the treatment / consultation.
Aggressive, improper or non-cooperative behavior gives Katinka Tchernova the right to immediately stop the treatment / consultation without the right to any compensation towards the client. The client must pay for his treatment / consultation.
If Katinka Tchernova is of the opinion that another form of treatment / consultation is appropriate, it is entitled to terminate the treatment and / or to refer it to other authorities.
All communications made by Katinka Tchernova / advice / treatments / consultations are without obligation; it is the client’s own responsibility to accept this. The client is advised to submit everything that is discussed during the treatment / consultation to and / or to have it checked by a (medical) expert before taking any decision and / or continuing the treatment / consultation.
Both parties are obliged to maintain the confidentiality of all confidential information that they have received from each other or from another source in the context of their agreement.
The treatment / consultation takes place against a fixed, pre-agreed, reimbursement of € 100.00 per hour incl. VAT for private individuals, and € 100.00 per hour excl. VAT for companies
After each treatment / consultation, the payment must be made as agreed. If payment is not made or not paid on time, all judicial and extrajudicial costs will be borne by the client. In that case, furthermore, all claims of Katinka Tchernova against the client under the relevant agreement and directly related agreements are immediately due and payable. In the event of late payment, Katinka Tchernova may suspend or terminate the work, without prejudice to the client’s payment obligation.
Arriving late for an appointment does not entitle you to extra time for guidance, the session will begin at the pre-arranged time. If cancelled 48 hours before the appointment, the appointment will be postponed to a later date. In the event of a late or no cancellation, the duration of the treatment will be charged.
During Skype consultations, Katinka Tchernova and the client are both responsible for a properly functioning Skype program. If, for whatever reason, the connection fails and recovery proves impossible at that time, the consultation will be continued at a different time after mutual consultation and approval.
Dutch law applies to every agreement between Katinka Tchernova and the client. The competent court is that in ‘s-Hertogenbosch
